Terms of service

These terms govern your use of www.giftmyway.in and any order you place with us. By placing an order you agree to them.

1. WHO WE ARE

GiftMyWay is a brand operated by Navya Advertising, Printing and Advertising Firm, with its registered office at Plot No - 3, Anand Industrial Estate, Mohan Nagar, Ghaziabad, Uttar Pradesh 201007. In these terms, "we", "us" and "our" mean Navya Advertising trading as GiftMyWay.

2. ELIGIBILITY

You must be 18 or older to place an order. If you are under 18, you may use the site only with the involvement of a parent or guardian, who takes responsibility for the order.

3. OUR PRODUCTS

We sell polaroid-style photo fridge magnets, printed to order with photographs you supply. Each magnet measures approximately 10 x 9 cm. Small variations in size, trim and finish are normal in a printed product.

4. YOUR PHOTOGRAPHS

When you upload a photograph you confirm that:
a) you own the photograph, or you have permission from the person who does
b) you have the consent of anyone identifiable in it
c) the photograph does not infringe anyone's copyright, trademark, privacy or publicity rights

You grant us a limited licence to reproduce, print and, where necessary, resize or crop your photograph purely to fulfil your order. This licence ends when we delete the file, 30 days after dispatch. We will never use your photograph for marketing.

You agree to indemnify us against any claim arising from a photograph you supply.

5. CONTENT WE WILL NOT PRINT

We will not print material that is unlawful, obscene, sexually explicit, hateful, defamatory, that depicts or exploits a child, or that infringes someone else's rights. If we receive such an order we will cancel it and refund you in full, and we may decline further orders from you.

6. PRICING AND PAYMENT

All prices are shown in Indian Rupees and include applicable GST. Shipping is free and already included in the price.

You can pay online at checkout or choose Cash on Delivery. Online payments are processed by our payment gateway. We may correct an obvious pricing error and will cancel and refund an affected order rather than fulfil it at the wrong price.

We may change our prices at any time. A change never affects an order already placed.

7. ORDER ACCEPTANCE

Your order is an offer to buy. A contract forms when we confirm your order by email. We may decline an order, and refund you in full, if we cannot print it, if a photograph breaches section 5, if we suspect fraud, or if we cannot deliver to your address.

8. PRINT VARIATION

Screens and printers reproduce colour differently. Small differences in colour, brightness and contrast between what you see on your device and what arrives in print are normal and are not a defect. The sharpness of your magnet depends on the quality of the photograph you supply.

9. CANCELLATIONS, RETURNS AND REFUNDS

These are covered by our Refund and Cancellation Policy, which forms part of these terms.

10. DELIVERY

Delivery is covered by our Shipping Policy, which forms part of these terms. Delivery estimates are estimates, not guarantees.

11. OUR INTELLECTUAL PROPERTY

The GiftMyWay name and logo, our ten frame designs, our website copy, layout and photography belong to us. You may not copy, reproduce or reuse them without our written permission. Buying a magnet gives you the physical product, not any right in the design printed on it.

12. LIMITATION OF LIABILITY

To the extent permitted by law, our total liability for any order is limited to the amount you paid for that order. We are not liable for indirect or consequential loss, including missed occasions, disappointment, or loss arising from a delayed delivery.

Nothing in these terms limits any right you have under the Consumer Protection Act, 2019 that cannot be limited by agreement.

13. EVENTS OUTSIDE OUR CONTROL

We are not responsible for delay or failure caused by events beyond our reasonable control, including natural events, strikes, transport disruption, power or internet failure, and government action.

14. PRIVACY

Our Privacy Policy explains how we handle your information and forms part of these terms.

15. GOVERNING LAW AND JURISDICTION

These terms are governed by the laws of India. The courts at Ghaziabad have exclusive jurisdiction over any dispute.

16. GRIEVANCE REDRESSAL

If you have a complaint, contact our Grievance Officer, whose details appear in our Contact Information policy. We acknowledge complaints within 48 hours and resolve them within one month, in line with the Consumer Protection (E-Commerce) Rules, 2020.

17. CHANGES

We may update these terms. The version published on this page when you place your order is the one that applies to it.
